1. Scope of Application
These Terms & Conditions apply to all purchases made via the website of JUNA FRANKA intuitive abstract art (Juliane Schmidt, Richard-Lehmann-Str. 25a, 04275 Leipzig, Germany). By placing an order, you agree to be bound by these terms.
2. Subject of the Contract
The artist sells original artwork created by JUNA FRANKA intuitive abstract art. Each piece is a unique work, signed by hand, and described individually on the website.
3. Prices and Payment
All prices are listed in Euro. Payment is due in full within 14 days of order confirmation. Shipping occurs after full payment is received.
Customers are responsible for any currency exchange fees, bank transfer costs, customs duties, and import taxes that may apply.
JUNA FRANKA intuitive abstract art is not liable for shipping delays caused by customs.
4. Shipping and Returns
Artwork is carefully packaged and shipped to the address provided.
Consumers in the EU have the right to withdraw from this contract within 14 days from receiving the artwork without giving any reason.
The withdrawal period is fourteen days from the day on which the buyer or a third party designated by them, who is not the carrier, takes possession of the goods.
To exercise the right of withdrawal, the buyer must inform JUNA FRANKA intuitive abstract art (Juliane Schmidt, Richard-Lehmann-Str. 25a, 04275 Leipzig, Germany, junafranka@proton.me) via email of their decision to withdraw from this contract by means of a clear statement. The attached sample withdrawal form can be used.
To meet the withdrawal deadline, it is sufficient that the communication concerning the exercise of the right of withdrawal is sent before the withdrawal period expires.
Consequences of withdrawal
If the buyer revokes this contract, JUNA FRANKA intuitive abstract art shall promptly and no later than fourteen days from the day on which notification of the revocation of this contract is received in writing by JUNA FRANKA intuitive abstract art, reimburse them for all payments received from the buyer, including delivery costs (with the exception of additional costs resulting from the fact that the buyer chose a type of delivery other than the reasonably priced standard delivery offered by JUNA FRANKA intuitive abstract art).
For this reimbursement, the same means of payment used in the original transaction will be employed, unless expressly agreed otherwise; in no case will the buyer incur fees for this reimbursement. The buyer is only responsible for any diminished value of the goods if this loss in value is attributable to a handling of the goods that is not necessary for checking the nature, characteristics, and functionality of the goods, and, for example, resulted in damage or soiling of the artwork.
The artist may withhold the refund until the artwork is returned in original condition.
The buyer must return or hand over the goods to JUNA FRANKA intuitive abstract art immediately, and in any event, no later than fourteen days from the day on which they inform JUNA FRANKA intuitive abstract art of the revocation of this contract. The deadline is met if the buyer sends back the goods before the period of fourteen days has expired.
The buyer bears the direct costs of returning the goods and ensures proper and secure packaging.
5. Warranty and Copyright
All artworks are original creations by JUNA FRANKA intuitive abstract art and are free from third-party rights. Furthermore, she affirms that the artwork is her independent, unique creation. All copyright and reproduction rights are revered by the artist. Warranty claims for any defects are excluded.
Copyright and reproduction rights remain solely with the artist.
6. Exhibition and Resale
Public exhibitions of purchased artwork require the prior written consent of the artist.
If the artwork is resold, the buyer agrees to inform the artist of the new owner’s name and address.
